Voluntary Leave--Vacation

One of the more planned-for employee leaves is vacation time. Federal law generally does not require either time off or pay for vacation. However, employers with certain federal contracts may be subject to vacation and other paid time off requirements, such as those covered by the McNamara O'Hara Service Contract Act (SCA) or the Davis-Bacon and Related Acts (DBRA). For more on these laws, please click here.  

But vacation days are nonetheless a very common employer-provided benefit. Like sick or personal days, vacation days can be offered largely at the employer’s discretion, including rules for eligibility, the number of days per year, and policies on carrying over to the next year. However, if an employer decides to provide vacation leave to its employees, the policy should be applied fairly and uniformly.
