Fair Labor Standards Act of 1938 (FLSA)

The Fair Labor Standards Act (FLSA), which prescribes standards for the basic minimum wage and overtime pay, affects most employment. The chart below provides a general overview of the FLSA and its requirements. However, please note that state laws also apply to employment subject to the FLSA. When both the FLSA and a state law apply, the law setting the higher standard(s) must be observed.
