Delaware State Law Delaware recognizes same-sex relationships under state law as follows: Same-Sex Marriage  Same-sex marriage is legal in Delaware. All state laws applicable to marriage or married spouses or the children of married spouses apply equally to same-gender and different-gender married couples and their children.   Persons of the same gender who are in legal unions (including marriages, civil unions, and domestic partnerships) established in other jurisdictions have the same rights, benefits, protections, and responsibilities as married persons under Delaware law. Civil Unions On July 1, 2014, all existing Delaware civil unions (that are not subject to a proceeding for dissolution, annulment, or legal separation) will automatically convert to marriages under state law. Between July 1, 2013, and July 1, 2014, parties wishing to convert a civil union to a marriage may apply for a marriage certificate or a marriage license from the county which issued the civil union license.
