Election Changes under Cafeteria Plans Overview

A cafeteria plan may permit an employee to revoke an election during a period of coverage and to make a new election only in certain circumstances, which include:

  • Special enrollment (including in a Health Insurance Marketplace plan)
  • Change in status events
    • Legal marital status
    • Number of dependents
    • Employment status
    • Dependent satisfying or ceasing to satisfy eligibility requirements
    • Residence
    • Adoption Assistance
    • Reduction in hours
    • Health Insurance Marketplace open enrollment
  • Judgments, decrees, or orders
  • Medicare or Medicaid entitlement
  • Significant cost or coverage changes 
  • FMLA Leave
  • Elective contributions under a qualified cash or deferred arrangement, i.e., 401(k) plan
