Federal Poster Requirements

Some of the statutes and regulations enforced by the U.S. Department of Labor (DOL) and other federal agencies require that notices be provided to employees or posted in the workplace. DOL provides free electronic and printed copies of its required posters through its elaws Poster Advisor.

The Advisor can be used to determine which posters employers are required to display at their places of business. Posters, available in English and other languages, may be downloaded and printed directly from the Advisor, or from the links in the chart below.

Notice: Employee Polygraph Protection Act  

 

WHO MUST POST:  Any employer engaged in or affecting commerce or in the production of goods for commerce.

OTHER INFORMATION:  The poster must be displayed where employees and applicants for employment can readily observe it.

Equal Employment Opportunity is the Law  

 

WHO MUST POST:  

  • Employers subject to Title VII of the Civil Rights Act; Title I of the Americans with Disabilities Act; the Age Discrimination in Employment Act; the Equal Pay Act; Title II of the Genetic Information Nondiscrimination Act; Section 503 of the Rehabilitation Act of 1973; and the Vietnam Era Veterans' Readjustment Assistance Act.
  • Employers with federal contracts or subcontracts and federally assisted construction contracts and subcontracts over $10,000.

OTHER INFORMATION: Post copies of the poster in conspicuous places.

Fair Labor Standards Act (FLSA) Minimum Wage Poster 



WHO MUST POST:  Employers of any employee subject to the Fair Labor Standards Act (FLSA).

OTHER INFORMATION:  Any employer of employees to whom Section 7 of the FLSA does not apply may modify the poster to show that the overtime provisions do not apply.

The poster must be easily readable.

Employee Rights Under the Family and Medical Leave Act  

 

WHO MUST POST:  Public agencies (including state, local, and federal employers), public and private elementary and secondary schools, as well as private sector employers who employ 50 or more employees in 20 or more work weeks. 

OTHER INFORMATION:  Where an employer’s workforce is not proficient in English, the employer must provide the notice in the language the employee speaks. The poster must be posted prominently where it can be readily seen by employees and applicants.

Job Safety and Health: It's the Law! Poster  

 

WHO MUST POST:  Private employers engaged in a business affecting commerce.

OTHER INFORMATION:  This Occupational Safety and Health Administration (OSHA) poster must be displayed in a conspicuous place. Reproductions or facsimiles of the poster must be at least 8 1/2 by 14 inches with 10-point type.

Your Rights Under the Uniformed Services Employment and Reemployment Rights Act Poster

 

WHO MUST POST:  The full text of the notice must be provided by each employer to persons entitled to rights and benefits under USERRA.

OTHER INFORMATION:  Employers may provide the notice by posting it where employee notices are customarily placed.

Employee Rights for Workers with Disabilities/Special Minimum Wage Poster

 

WHO MUST POST:  Every employer having workers employed under special minimum wage certificates authorized by section 14(c) of the FLSA.

OTHER INFORMATION:  The notice must be placed in a conspicuous place on the employer's premises where employees and the parents or guardians of workers with disabilities can readily see it. Where an employer finds it inappropriate to post such a notice, the employer may provide the poster directly to all employees subject to its terms.

Notice of Employer Participation in E-Verify

Employers participating in E-Verify are required to post the notice provided by the Department of Homeland Security indicating the company’s participation in the E-Verify program.

Employers participating in E-Verify are required to post the anti-discrimination notice issued by the Immigrant and Employee Rights Section of the Department of Justice.

WHO MUST POST:  Entities holding federal contracts or subcontracts or federally assisted construction contracts exceeding $10,000 must post this supplement to the Equal Employment Opportunity is the Law poster.

OTHER INFORMATION:  The notice must be posted prominently, where it can be readily seen by employees and applicants.

Pay Transparency Nondiscrimination Provision

WHO MUST POST:  Entities holding federal contracts or subcontracts (or federally assisted construction contracts or subcontracts) exceeding $10,000.

OTHER INFORMATION:  Employers covered by Executive Order 11246, as amended, are also required to include the Pay Transparency Nondiscrimination Provision in employee manuals and handbooks. Posting may be accomplished electronically or by posting a copy of the provision in conspicuous places available for employees and applicants.

Federal Minimum Wage for Contractors (Executive Order 13658)

 

WHO MUST POST:  Parties with the following kinds of federal government contracts:
  • Procurement contracts for construction covered by the Davis-Bacon Act (DBA);
  • Service contracts covered by the Service Contracts Act (SCA);
  • Concessions contracts; and
  • Contracts in connection with federal property or lands and related to offering services for federal employees, their dependents, or the general public.
OTHER INFORMATION:  The order applies to prime contracts covered by the DBA that exceed $2,000 and prime contracts covered by the SCA that exceed $2,500.

Notification of Employee Rights Under Federal Labor Laws

 

WHO MUST POST:  Federal contractors and subcontractors must post the notice in plants and offices where employees covered by the NLRA perform contract-related activity.

OTHER INFORMATION:  The notice informs employees of federal contractors and subcontractors of their rights under the NLRA to organize, bargain collectively, and engage in other protected concerted activity.

Poster must be at least 11 by 17 inches.

Notice to All Employees Working on Federal or Federally Financed Construction Projects  

(Davis-Bacon Act)

WHO MUST POST:  Contractors and subcontractors engaged in contracts in excess of $2,000 for federally assisted construction projects.

OTHER INFORMATION:  The poster must be posted at the site of work, in a prominent and accessible place where it can easily be seen by workers.

The two printed pages must be taped or pasted together to form an 11 x 17 inch poster.

Notice to Employees Working on Government Contracts

(Public Contracts Act, Service Contracts Act)

WHO MUST POST:  Contractors or subcontractors engaged in a contract with the United States or the District of Columbia in excess of $2,500, the principal purpose of which is to furnish services in the U.S. through the use of service employees.

OTHER INFORMATION:  The notice must be posted in a location where it may be seen by all employees performing on the contract.

Paid Sick Leave for Federal Contractors

 

 

WHO MUST POST:  Executive Order 13706 applies to four major categories of contractual agreements:
  • Procurement contracts for construction covered by the Davis-Bacon Act (DBA);
  • Service contracts covered by the McNamara-O'Hara Service Contract Act (SCA);
  • Concessions contracts; and
  • Contracts in connection with federal property or lands and related to offering services for federal employees, their dependents, or the general public.
